Property damage is all costs and losses incurred in the injured party’s property, as a result of a specific event occurring. Property damage may occur in two forms: losses that the injured party suffered (damnum emergens) and loss of benefits that could have been achieved if the damage had not been caused (lucrum cessans). What is the amount of compensation for property damage?

The amount of compensation is a crucial issue. What compensation is due for property destruction is of interest not only to the injured party (how much compensation he or she is entitled to), but also to the perpetrator (how much compensation he or she will have to pay). Estimating compensation for property damage is therefore a fundamental matter. It is usually done as follows:

In the event of complete destruction (loss) of some property, compensation is calculated based on the market value of this asset, assumed on the date of the accident. The injured party usually receives what his property was worth on the date of its loss.
